At the very end of last year, we were hit with the crushing news that the Australian Appeals Tribunal (AAT) had denied our request to access secret information through the Freedom of Information (FOI) Act.
Information we believe should be publicly available. Information that could be devastating for Moreton Bay — a wetland of international significance and home to an abundance of our most precious wildlife and endangered migrating birds.
That’s why we are appealing to the Federal Court!
Our case is fundamentally about elevating the importance of transparency in environmental decision-making. Negotiations and information between elected representatives and developers should be made public, especially when they are also donors to political parties.
Unfortunately, pursuing these cases through court is costly. Standard costs for these types of cases can be upwards of $100,000. This falls outside the cost of all our other critical work protecting the places we love.

- we can overturn the poor precedent in the AAT decision to deny access to documents, which should be publicly accessible, highlighting and elevating the importance of political transparency in environmental decision-making;
- we will further highlight the need for a national environmental independent regulator, free from political interference; and most importantly,
- we could gain access to hidden information that helps us to protect the internationally recognised precious habitat of Moreton Bay.
